MORE PLANNING HANKY PANKY IN MONKEY TOWN

In my view it is vitally important if not essential to understand the Major Part if not the most Important Critical Part  played  by Richard Trow   Hartlepool Council Planning Officer enthusiastically  assisted  by Mr. Reece,  the Development Control Manager who together Deliberately  Conspired to Pervert the Course of Justice when they  jointly Decided to  “Grant” a Highly Controversial Retrospective Planning Application H/2009/0568 for a friend, knowing the application was Legally Flawed.

 I Seriously Question the personal integrity   of Richard Trow and his  involvement in this Highly Controversial Retrospective Planning Application, when one considers that he  himself admitted to me at our first meeting  held in  Brian Hanson House in August/September 2008 * that he was the Architect/Draughtsman personally engaged by the Retrospective Planning Applicants NOT only to Design the Detailed Drawing for the New Kitchen Extension but to assist and Personally advise the Planning applicants on HOW Best to obtain Planning approval from Hartlepool Planning Authority,

It is Important to note that Richard Trow, was employed by Hartlepool Borough Council as a Planning Officer &  would have been or should have been  fully  Conversant &  knowledgeable on HOW, Retrospective Planning approval could  be Quietly  and Discretely achieved  for the  Disputed Retrospective Planning  application H/2009/0568 he knew it   Contained  False Claims of Property “Ownership” & was therefore  Legally Flawed.- WITHOUT - It  should  be noted , the involvement of any of the Democratically Elected Councillors on the Hartlepool Planning Committee, No Consultation, No Seeking Guidance or Legal  Advice  for such a Disputed Controversial Retrospective Planning Application

Hindsight is a wonderful thing- there can be little doubt now, WHY Richard Trow’s was so Confident and Certain at the Meeting held  in  Brian Hanson House August/September 2008 *  that the Initial  Planning application H/2008/0467 later change to that legally flawed  Controversial Retrospective Planning application H/2009 0568 would be approved & eventually granted planning permission  by Hartlepool Planning authority,

He Himself Richard Trow Hartlepool Councils Planning Officer  on assuming  personally responsible for this Project H/2009 0568 assisted by Mr Reece Control Planning Manager  would use  HIS  Delegated  Power of Authority in the total  absence of the Hartlepool Planning Committee to decide the final outcome of this Highly Controversial Retrospective Planning Application.

A  Very Unhealthy  Situation  for a  Council Officials to be placed in, there is always the Suspicion even  the  Possibility which has happen before- that Council  Officials Particularly Planning Officers  when dealing with a Strongly Disputed  Controversial  Retrospective Planning application as H/2009/0568  could be offered and have  accepted  some  kind of inducement it need not be money, to adopt a dishonest course of action  by  Granting Planning approval for a Strongly  Disputed  Retrospective  Planning  Application, although fully Conscious  that this Particular Retrospective Planning application  Contained False Claims of Property “Ownership” & was therefore  Legally Flawed.

Imagine  the following  Scenario,  a  School Boy Placed in a very Similar Position, alone in his classroom WITHOUT  any School Teachers  present  being allowed to Alter or Mark  his  OWN  Examination Papers, would it be a Complete and Utter Surprise  to find the School Boy had passed his examination with flying colour, even Top Marks .

It is Important to keep in mind,  that Richard Trow the Planning Officer for this Project had been informed on Numerous Occasions has had Hilary Martin, F,O.I. Officer,  Alyson Carman, Solicitor & Complaints Reviewer, (who had requested &  been given  an Official Copy of the Register of Title in  December 2008 )  and  Paul Burgon, Enforcement Officer, that the Retrospective Planning applicants H/2009/0568 – had  NOT  repeat had NOT Purchased from Hartlepool Borough Council in 1972,  any of the Disputed  Property, and therefore DID NOT repeat DID NOT OWN any of the Freehold Land & Property their Illegally built Kitchen Extension  had  been Built on,

Rt. Hon Lord Denning , Lord Chief Justice  His Appeal Court Ruling January 12.13.24.1956 was –No Court in this Land  will allow a person  to keep an  advantage he has Obtained by FRAUD , NO  Judgement of a Court, NO order of a Minister can be allowed to stand if it has been Obtained by FRAUD –FRAUD unravels  everything.

It is also important to Remember that both Richard Trow Planning Officer and Mr Reece, Development Control Manager, were Both Well Paid Senior Council Planning Officials employed in Positions of Trust in  Public  Office, although  neither were Legally Qualified. it was NOT in my view, Unreasonable for members of the General Public to have expected BOTH these Highly Paid  Senior Council Officials employed by Hartlepool  Borough Council in the Planning Department  to have  at Least a  Basic Working Knowledge  if  NOT  Fully Conversant with the Town & Country Planning Act 1990, & Both  Should have known  that Ownership Certificates A.B.C & D. are a Statutory Requirement under Sections 65(5) of the Town & Country Planning Act 1990

I was also Informed In answer to a Freedom Information request I made to the Office of the Secretary of State for Communities and local Government, the Right Honourable ERIC PICKLES M.P.  

It is  a Criminal Offence under Section 65(6) of the Town & Country Planning Act 1990 to issue a Certificate Knowing it Contains False or Misleading information.

The local Planning authority, in this case, Richard Trow, the Hartlepool Council Planning Officer, assisted by   Mr. Reece, Development Control Manager, KNEW  or Should  Have KNOWN they   “Must Not Entertain” an application for Planning  Permission  Unless  the Relevant Certificates  Concerning  the Ownership” of the Applicants  Site have been Completed  Stating the “Ownership” of the Property

Copies to be sent to the under mentioned although ALL have been previously made aware of the Corrupt Situation festering in Hartlepool

 NONE of the above named Labour Councillors have sought fit to acknowledge or even attempted to contact me to explain .WHY my Serious Criminal  Allegations have been Ignored, Instead  they collectively instructed PETER DEVLIN believed to be the Chief Solicitor of Hartlepool to write to me to me to say in essence ,that if I have any other Critical Comments  to make, I should submit them to him first & NOT  to my elected ward Labour Councillors,
This is Freedom of Speech Hartlepool  NEW LABOUR   Style, an obvious attempt to  TRY and INTIMIDATE  or  FRIGHTEN this  OLD FART, they know I am an OCTOGENARIAN  & Hope I will Just Fade Away,
They  ALL Know  a Simple visit to my Home as was undertaken by ROB COOK ( a Genuine Incompetent  would be Politision  Compulsive Liar ) prior to his election  as the De-Brus Ward Councillor,   would quickly establish and Prove my Allegation Correct.

There can be no room for Misunderstanding or Further Doubts when one considers the Previous favourable & Extra Special treatment given to this Particular Retrospective Planning Applicant H/2009/0568

(a)            Being allowed to Operate a Business enterprise from a Council House , Strictly Prohibited in  Council Tenancy agreements

(b)            Allowed to Purchase their Council House Property in 1972, at a Time of a Critical National Shortage of Social Housing- a Privilege denied to others.

(c)             Allowed to Continue Operating  a Business Enterprise in their  newly Purchased Ex-Council House , although expressly Prohibited in  the Registered Land Title Covenants

Shocking - Unbelievable  - BUT TRUE - Once you get over your initial shock, you will no longer doubt MY Allegations that All  the Undermentioned Council Officials , Richard Trow, Planning Officer, Hilary Martin, F,O.I. Officer Alyson Carman, Solicitor & Complaints Reviewer, (who had requested &  been given  an Official Copy of the Register of Title in  December 2008 and  Paul Burgon, Enforcement Officer, Conspired -Collaborated with the Retrospective Planning Applicants H/2009/0568 to Pervert the Course of Justice, & to Falsely Claim  by Criminal Deception “Ownership” of Registered Land & Property NOT in their Registered Title !

Please Note, If anything I have Written or Published is NOT TRUE – Why have NONE repeat NONE  of the  named Hartlepool Council Individuals Disputed any of my allegations, NOR Commenced ANY Legal Proceeding against ME for Slander, or whatever other crimes they can think of, BUT remember  a Council Cannot Sue for Libel ( Derbyshire  vs  Sunday Times , House of Lords. 1993 ) NOR can it Indemnify a Councillor or Council Officer who wishes to Sue an Individual (Local authorities  indemnity  for Members and Officers ) order 2004 ?
